Privacy Policy

This Privacy Policy ("Policy") describes how we collect, use and share data that we obtain through your use of the Internet site(s), applications, email and newsletter communications, podcast(s) and online Services (the "Services") operated by, controlled by, or affiliated with LexReg, LLC (which operates under the LexRegPulse brand) ("LexReg," "we," "us," or "our"). By accessing the Services, you signify that you have read, understand and agree to be bound by this Policy and the Terms & Conditions. Because the Services may change, this Policy may change over time. Anytime we modify the Policy we will post a revised version on the Services and update the Last Updated above. Certain parts of the Services and other LexReg offerings work differently and may be subject to additional terms and conditions. Our Services are solely made available to individuals over the age of 18.

1. Collection of Data

We collect data from you in several different ways on and through the Services, including personal data and data about your use of the Services which does not identify you personally. Personal data means information, or combination of information, that can reasonably be used to identify you personally (such as your name, phone number, address, and email address).

We collect personal data that you voluntarily provide to us.

We collect personal data that you voluntarily provide to us (such as when you submit an inquiry, request a demo, subscribe to our daily or weekly briefings, sign up for API access, or register for an enterprise deployment), including name, email address, company name, job title, telephone number, subscription and account preferences, API access credentials, and any other data you choose to provide.

We automatically collect data about your use of the Services.

When you access and use the Services, our technology and tools may automatically collect and record certain data about your use of and interaction with the Services that does not identify you personally (such as your IP address, browser type, the make and model of device used to view the Services, unique device identifiers, the referring webpage, pages visited, search terms, advertising identification numbers, and log files).

We may also use various tracking technologies (such as cookies and pixel tags) to collect data about your use of and access to the Services. Cookies are small data files stored on your hard drive or in device memory by websites you visit, applications you use, or advertisements you view and help us improve the Services and your experience on the Services. Pixel tags are electronic images that generate a generic notice of a visit to the Services and are used in conjunction with cookies to anonymously track activity on the Services by a particular browser.

Some content on the Services may be served by third-party content providers or advertising partners that deliver ads on the Services, and such third parties may also use cookies, pixel tags, or other similar tracking technologies to automatically collect data about you, both on the Services and throughout the Internet. We use the data we collect to assist in the administration and operation of the Services and to provide you an efficient, meaningful, and customized experience.

• Optimize your experience on the Services (such as troubleshooting technical programs or storing your preferences);

3. Sharing of Collected Data

We may share the data we collect as follows:

• With our current and future parents, affiliates, subsidiaries, and other companies under common control and ownership;
• With our service providers that perform services for us (such as e-mail marketing, analytics, and web hosting);
• With our sponsors, promotional partners, or event partners in connection with certain promotions or events;
• With our third-party vendors and partners that sell items, offer promotions, or provide services to you through our services (either alone or jointly with us), as well as third-party advertisers, agencies, networks, ad measurement providers, and other marketing and advertising providers and partners;
• To comply with a court order or other legal obligation, to enforce the Services terms of use, and to protect the rights, property, or safety of our users and other third parties;
• With government or law enforcement officials or private parties (including our legal or other professional advisors) as we determine, in our sole and absolute discretion, is necessary or appropriate to respond to claims or to comply with legal processes, laws, regulations, or ordinances, or to prevent or stop illegal, unethical, or actionable activity;
• In connection with, or during negotiations of, any merger, acquisition by another company, or sale of all or substantially all of our business or assets; and
• With your consent or at your direction.

4. Transfer of Collected Data

The Services are operated in the United States. If you are located in another jurisdiction, please be aware that the data we collect will be transferred to, stored, and processed in the United States. By using the Services and/or providing us with any data, you consent to this transfer, processing, and storage of your data in the United States, a jurisdiction in which the privacy laws may not be as comprehensive as those in the country where you reside or are a citizen such as the European Union. We will take all steps reasonably necessary to ensure that your data is subject to appropriate safeguards and is treated securely and in accordance with this Policy.

We use commercially reasonable technical and organizational measures to help secure and safeguard your data in our possession. However, no data transmission over the Internet is completely secure and no security mechanism is impenetrable. Therefore, although we take steps to protect your data, we cannot guarantee the security of the data that we collect from you or the security of our servers or the Services. By accessing the Services, any transmission of data is at your own risk and you agree to assume all risk in connection with data sent to us or collected by us.

6. Data Retention

We retain data only as long as necessary in light of the purpose(s) for which it was originally collected. Please note that we may retain your data for longer periods of time as necessary to comply with our legal obligations or respond to governmental authorities.

7. Children and Parents

We respect children's privacy. We do not target or knowingly or intentionally collect personal data from children under the age of 13. By using the Services, you have represented and warranted that you are either at least 18 years of age or using the Services with the supervision of a parent or guardian. 8. Our "Do Not Track" Policy

Some websites have "do not track" features that allow you to tell a website not to track you. Except as set forth herein, we do not currently respond to such signals or any similar mechanisms transmitted by web browsers.

9. Your Data Preferences

You may exercise any of the choices described below by contacting us at [email protected]. We will respond to your request within the timeframe required by applicable law. We may need to take reasonable steps to verify your identity before acting on your request, and we will not discriminate against you for exercising any of these rights.

Use of Collected Data

Deletion of Collected Data

If you want us to delete your collected data, please submit a request by emailing us at [email protected]. We will delete your data unless we are required or permitted by applicable law to retain it.

Communications

If you no longer wish to receive communications from LexReg, you may opt out at any time by following the unsubscribe instructions included in those emails or by emailing us at [email protected]. We will honor your request within the period required by applicable law. Please note that we may continue to send you non-promotional or transactional messages, such as those relating to your account, a transaction, or our ongoing business relationship, even after you opt out.

Cookies, Pixel Tags, and Other Similar Tracking Technologies

You may also remove or reject cookies by adjusting settings on your browser, and thus opt-out of certain features of the Services and the Services' automatic collection of certain data. These tracking technology opt-out tools are device and browser specific so you must repeat the opt-out from each of your devices and browsers. Please note that removing or rejecting cookies could affect the functionality of the Services.

You may also remove certain tracking technologies and opt-out of online behavioral advertising messaging by using the opt-out tools available from the Digital Advertising Alliance (DAA Opt-Out Tool), the Network Advertising Initiative (NAI Opt-Out Tools), and Nielsen (Nielsen Opt-Out).

Advertising Preferences

You may adjust your advertising preferences on various social media websites or third party platforms by adjusting your Settings on the particular platform.

10. Additional Disclosures for California and Other U.S. State Residents

This Section applies only if you reside in California or another U.S. state whose law provides some or all of these rights. We extend the rights described below to residents of other U.S. states that have enacted comprehensive privacy laws (such as Virginia, Colorado, Connecticut, Texas, and Utah), regardless of whether their law includes every right listed here.

Categories of personal information. In the past 12 months, we may have collected the following categories of personal information, as defined under the California Consumer Privacy Act, as amended by the CPRA ("CCPA"): identifiers (such as name, email address, IP address, and device identifiers); internet or other electronic network activity information (such as browsing and usage data); commercial information; and inferences drawn from the above. The sources of this information, the business and commercial purposes for collecting it, and the categories of third parties to whom we disclose it are described in Sections 1 through 3.

"Sale" and "sharing" of personal information. We do not "sell" your personal information or "share" it for cross-context behavioral advertising, as those terms are defined under the CCPA.

Sensitive personal information. We do not collect or process sensitive personal information as defined under the CCPA.

Your rights. Subject to certain exceptions, you have the right to: (a) know and access the personal information we have collected about you; (b) correct inaccurate personal information; (c) delete your personal information; (d) obtain a portable copy of personal information you have provided to us; (e) opt out of the "sale" or "sharing" of your personal information and of targeted advertising; and (f) to the extent we engage in such profiling, opt out of profiling in furtherance of decisions that produce legal or similarly significant effects concerning you. You also have the right not to receive discriminatory or retaliatory treatment for exercising these rights.

Authorized agents. You may use an authorized agent to submit a request on your behalf. We will require the agent to provide proof that you authorized them to act for you, and we may still need to verify your identity directly.

How to exercise these rights. To exercise your rights by email, send a message to [email protected] with the subject line "Attention - Privacy Request" and include the following information so we can verify your identity and process your request:

• First and last name
• Email address we should use to correspond with you about the request
• State (and country, if outside the U.S.) of residence
• Whether you are submitting the request on your own behalf or as an authorized agent for another consumer (if as an authorized agent, attach proof of authorization)
• The specific right you are exercising, for example: (a) opt out of the sale of personal information, (b) opt out of the sharing of personal information for cross-context behavioral advertising, and/or (c) opt out of processing for targeted advertising
• (Optional) Phone number and mailing address, and any additional detail that will help us identify your records

We will acknowledge your request and respond within the timeframes required by applicable law (generally within 45 days, with one permitted extension). We will verify your identity as described in Section 9 before acting on a request.

Appeals. If we decline to act on your request, you may appeal that decision by emailing us at [email protected] with "Privacy Request Appeal" in the subject line. We will respond to your appeal within the timeframe required by applicable law. If your appeal is denied, you may contact your state attorney general to submit a complaint.
