State bank supervisors ask Treasury to keep stablecoin issuers operating during review
State bank supervisors on October 20 asked Treasury to keep state-approved stablecoin issuers operating while federal reviewers weigh their states' rules. Their letter, led by the Conference of State Bank Supervisors (CSBS), and one from the American Bankers Association (ABA) now frame the record on Treasury's GENIUS Act issuance proposal (91 FR 53368). The ABA wants the final rule to close routes that would let nonbanks bring unregulated stablecoins into the US through intermediaries, and to draw clear lines so that banks serving issuers face no criminal liability for another party's violation. Comments closed October 19.
▸The states' parity case: CSBS filed with three other state groups, among them the Money Transmitter Regulators Association. They argued that the proposal threatens parity between state-approved and federally approved issuers. They asked that a state issuer keep operating while the Stablecoin Certification Review Committee reviews its state's certification, and through any cure period after an initial denial; they also want a safe harbor for issuers in states that file conditional certifications promising compliant laws by January 18, 2028. The Act takes effect January 18, 2027, unless a final rule moves it sooner. Every issuer rule is still proposed.
▸The ABA's other requests: Beyond closing the intermediary route, the ABA asked Treasury to define key terms so issuers cannot sidestep their obligations, and to hold foreign issuers to substantively equivalent standards. It wants holders protected when an issuer's status changes, with notice of the change and a clear path to redeem or divest their coins. It also asked for better coordination among the agencies writing GENIUS rules. The Fed's issuer proposal (91 FR 61580) takes comments until November 30.

REGULATORY DEVELOPMENTS
Treasury put money behind fraud tips, the community reinvestment file took in its last major letters, and Utah sued Kalshi; none imposes a new duty on banks.
▸A $25 million fraud tip line: Treasury said it will commit $25 million to the Justice Department's new Fraud Whistleblower Incentive Program, which gives Americans one place to report suspected fraud. "Every dollar lost to fraud is a dollar stolen from the most vulnerable among us," Treasury said. The program follows Treasury's October 19 report that Financial Crimes Enforcement Network (FinCEN) had referred about $270 million in suspected student-aid fraud, drawn from bank suspicious activity reports, to investigators. Eligible whistleblowers may receive $10,000 to $30,000. Payouts require tips that lead to criminal charges.
▸Community reinvestment file, late letters: Letters now posted on the Office of the Comptroller of the Currency (OCC) and Federal Deposit Insurance Corporation (FDIC) Community Reinvestment Act (CRA) proposal, whose comments closed October 13, pull in different directions. The Mortgage Bankers Association warned of regulatory fragmentation because the two agencies are acting without the Federal Reserve, noting that past non-aligned rules were later withdrawn or rescinded. Americans for Financial Reform opposed the proposal, saying a bank could earn a satisfactory rating with community development loans or investments equal to 0.625 percent of tier 1 capital, against current medians of 6.8 percent for lending and 3.6 percent for investments. It estimates an $87.1 billion annual drop. The New York Bankers Association backed the $1 billion and $10 billion thresholds.
▸Utah sues Kalshi: Utah Attorney General Derek Brown sued Kalshi in state court on October 20, alleging that its sports event contracts are illegal gambling and a public nuisance. “Kalshi runs an online casino in Utah and calls it a prediction market,” Brown said. The suit seeks an injunction, restitution for residents and recovery of an estimated $30.6 million to $61.2 million in fees. Kalshi says it is a federally regulated exchange overseen by the Commodity Futures Trading Commission and that no single state should have a veto over it. A federal court sided with Utah in August. Kalshi has appealed.
INDUSTRY AND AI SIGNALS
▸Oil near $100 again: Crude futures rose about 2 percent to near $100 a barrel in pre-market trading as attacks on vessels in the Strait of Hormuz continued, the Wall Street Journal reported. Reuters' Morning Bid said wild swings in oil and AI stocks expose growing market nerves over war and tech valuations. The 10-year Treasury yield stood at 5.14 percent, up about 2 basis points. Nearly all economists in a Reuters poll expect the Fed to skip an October increase and raise rates again in December. Pending home sales fell 7.3 percent in September to a record low.
▸Tesla and SpaceX weigh a merger: Elon Musk says Tesla and SpaceX are discussing a potential tie-up that would create a $3.5 trillion technology company, the Wall Street Journal reported. Neither company has announced a deal.
▸Trust-charter queue grows: Zaria Systems raised $5.2 million in seed funding led by Lightspeed Venture Partners while it seeks Office of the Comptroller of the Currency approval for Zaria National Trust Bank. The company provides loan servicing, backup servicing, collateral management and agency services to traditional lenders and lenders backed by digital assets. Ramp, valued at $60 billion after raising $1.85 billion last week, runs its checking accounts through First Internet Bank of Indiana, FinanceFeeds reported, and its trust-bank plan would bring digital-asset custody in-house rather than relying on third-party custodians. Both filings arrive as the Independent Community Bankers of America (ICBA) presses its October 2 lawsuit against the OCC over the run of trust charters. Trust banks take no deposits and make no loans.
▸Small banks change hands: Three bank acquisitions came to light, one by a credit union. Dime Commercial Bancshares agreed to buy ES Bancshares in New York, and Texas Banc Financial agreed to buy Haskell Bancshares in Texas. DFCU Financial, an $8 billion-asset Michigan credit union, is buying Sarasota's Gulfside Bank, its fourth Florida transaction since 2023. ICBA President Rebeca Romero Rainey said policymakers should address the credit union tax and regulatory exemptions that fuel such deals; the group has also told Treasury that federal credit unions should file Form 990. ICBA wants the exemption ended above $1 billion.
▸KeyCorp on deposits: KeyCorp, whose earnings per share beat estimates by 8.5 percent, now expects client deposit growth beyond its original $3 billion target. It said loan growth for the rest of 2026 should be fully funded by client deposits. The Cleveland bank projects continued profit growth in 2027 as a large portfolio of lower-yielding assets rolls off its balance sheet. Key raised its deposit outlook.
▸Two vendor incidents: Two incidents hit technology providers that many financial firms share. An extortion group called n0n says it holds access secrets for the payment infrastructure of Finzly, whose clients include Synovus and First Citizens, American Banker reported. In the UK, a Google Cloud disruption on October 20 in its europe-west2 region took down websites and apps at banks including HSBC, Revolut and Lloyds. Finzly is investigating.
▸Agents reach the invoice: The card networks moved AI agents from shopping toward paying business bills, a business where banks compete. Visa launched with BILL and Billtrust what it calls the first live pilot letting AI agents initiate and complete approved buyer invoice payments end-to-end through supplier portals. Mastercard opened early access to Agent Pay for Machines, which lets autonomous agents buy digital services over the open x402 protocol. Banks face the same agents from the account side. RBC is considering blocking Meta's Muse agent.
▸Anthropic's prospectus shows the cost of the model race: Anthropic logged a net loss of more than $80 billion in the first half of 2026, Reuters reported, citing the Wall Street Journal, which obtained the AI lab's IPO prospectus. The Journal said the filing shows red-hot growth alongside massive computing costs. OpenAI is racing to raise $30 billion before the listing. Banks run both labs' models in their operations. Anthropic is expected to list next month.
WHAT IT MEANS
▸Treasury's issuance rule could create a third issuer status that banks must track: pending state certification. If Treasury grants the states' request, a state-approved issuer could keep operating while its state's certification sits under review or in a cure period. The ABA's asks for clear lines on ordinary services and for notice to holders when an issuer's status changes would set what a bank serving that issuer must check. Banks logging which issuer backs each coin on their new card-network and core-system rails would need a column beside approved and not approved.
